Why 11 months, not 12?
Section 17(1)(d) of the Registration Act, 1908 makes registration mandatory for any lease longer than 12 months. Registration costs 1% of the annual rent plus deposit (capped) on top of stamp duty. Can I make a rent agreement online in India?
Yes. You can draft a rent agreement online, buy e-stamp paper through the SHCIL portal in most states, print the stamped agreement, and sign it in front of witnesses. For Maharashtra and a handful of other states, you can also register the agreement online through the state's IGR (Inspector General of Registration) portal using Aadhaar-based e-signature.
Is an online rent agreement legally valid?
Yes. An online rent agreement is fully valid under the Indian Contract Act, 1872 and state stamp acts, provided it is printed on appropriate stamp paper (or accompanied by an e-stamp certificate) and signed by both parties along with two witnesses.
Do I need to register an online rent agreement?
Registration is mandatory in Maharashtra regardless of term. In other states, registration is required only for tenancies longer than 12 months. Most landlords use an 11-month term specifically to avoid mandatory registration.
How much does an online rent agreement cost?
