Rent agreement registration in India

Registration of a rent agreement gives it the highest evidentiary weight in court and protects both landlord and tenant from title and boundary disputes. Under Indian law, registration is mandatory only for tenancies longer than 12 months — and, exceptionally, for all leave-and-license agreements in Maharashtra.

How to register online — Maharashtra

  1. Visit efilingigr.maharashtra.gov.in and create an account.
  2. Select "Public Data Entry (e-Registration)".
  3. Fill in landlord, tenant and property details.
  4. Upload scanned property documents and ID proofs.
  5. Pay stamp duty and registration fee online (BBMP / MahaOnline gateway).
  6. Complete Aadhaar-based e-KYC for all parties (OTP + biometric at CSC if needed).
  7. Download the registered agreement with the sub-registrar's digital signature within 2–3 days.

Offline registration — any state

  1. Calculate and pay stamp duty (via e-stamp or physical stamp paper).
  2. Book an appointment at the sub-registrar's office for the locality of the rented property.
  3. Landlord, tenant and two witnesses must appear in person with original ID proofs.
  4. Sub-registrar verifies identities via biometric and records the agreement.
  5. Pay the registration fee (1% of rent + deposit, capped).
  6. Collect the registered agreement (usually the same day or within 48 hours).
Why skip registration: Most urban Indian landlords use 11-month agreements specifically because Section 17 requires registration only for tenancies exceeding one year. An 11-month agreement is fully enforceable without registration — except in Maharashtra.

Is rent agreement registration mandatory in India?

Registration is mandatory only for tenancies longer than 12 months under Section 17(1)(d) of the Registration Act 1908 — with one major exception: in Maharashtra, leave-and-license agreements must be registered regardless of duration under the Maharashtra Rent Control Act 1999. Most landlords use 11-month agreements to sidestep the registration requirement.

How much does rent agreement registration cost?

Registration fee is 1% of (annual rent + deposit), capped at ₹30,000 in most states and ₹20,000 in Maharashtra. This is in addition to stamp duty. The registration fee is paid to the sub-registrar at the time of registration.

How long does registration take?

In Maharashtra, online registration through efilingigr.maharashtra.gov.in using Aadhaar e-KYC takes 2–3 business days. Offline registration at the sub-registrar's office can be completed in a single visit lasting 1–3 hours. Other states typically take 3–7 business days.

What documents are required for registration?

Landlord and tenant ID proofs (Aadhaar, PAN), property ownership documents (sale deed or latest property tax receipt), the stamped agreement, and two witnesses with ID proof.
