Legal Notice to Tenant to Vacate: India Format 2026
Key takeaways
- Without a contrary agreement or state law, Section 106 TPA allows 15 days' notice for a monthly tenancy, counted from the day the tenant receives it.
- The notice must be in writing, signed by or for the landlord, and served by post, hand delivery or (if those fail) affixing on the property.
- State rent acts and MTA-based state laws can override the agreement and usually require a recognised ground.
- A notice does not remove the tenant; possession is recovered through the civil court, small causes court or Rent Authority, never by force.
- This is general information, not legal advice; have a local advocate review the notice before serving it.
A legal notice to tenant to vacate in India is a written, signed letter that ends the tenancy and names the date by which the tenant must hand back vacant possession. If the agreement and state rent law are silent, Section 106 of the Transfer of Property Act allows 15 days for a monthly tenancy, counted from the day the tenant receives it.
This page gives you a free, fully visible legal notice to tenant to vacate format for India, wording for the common grounds (arrears, expiry, personal need, misuse), a table showing which notice period applies to your tenancy, and a proof-of-service checklist built on Section 106(4). It is general information, not legal advice: tenancy law in India depends on your agreement, your state and the type of premises, so have a local advocate review the notice before you serve it.
Legal notice to tenant to vacate: the short answer
Any landlord, or someone authorised to act for the landlord, can send the notice. The Transfer of Property Act, 1882 does not require a lawyer's letterhead. What it does require, under Section 106(4), is that the notice is in writing, signed by or on behalf of the person giving it, and actually delivered to the tenant in one of the ways the section lists. A notice with perfect wording is still weak if you cannot prove the tenant received it, and that gap is where landlords most often lose time later.
The minimum contents of an eviction notice format in India are simple:
- Names and addresses of the landlord and the tenant, and the full address of the rented premises.
- The basis of the tenancy: the date of the rent agreement (or the date the oral monthly tenancy began) and the monthly rent.
- A clear statement that the tenancy is terminated, and the date on which it ends.
- The reason (ground) where your agreement or state rent law requires one.
- A demand to hand over vacant and peaceful possession, keys and any arrears on or before that date.
- Date, place and signature.
Section 106(2) adds one practical rule that many free templates miss: the notice period runs from the date the tenant receives the notice, not the date you write or post it. Build a margin of several days into the termination date for postal delivery.
Which notice period applies to your tenancy
No single notice period applies to every rented flat in India. Four layers decide it, and the more specific one usually prevails, so work through them in order.
Your agreement's notice clause
Section 106 opens with the words "in the absence of a contract or local law or usage to the contrary". If your written rent agreement says either side may end the tenancy with, say, one or two months' notice, that clause normally governs the notice you give, provided no state rent law overrides it. Read the clause carefully: some agreements also include a lock-in period during which the landlord cannot terminate except for breach.
State rent control law
Many premises are covered by a state rent statute, such as the Maharashtra Rent Control Act, 1999, the Delhi Rent Control Act, 1958 or the Tamil Nadu Buildings (Lease and Rent Control) Act, 1960. The 2026 Chambers practice guide on Indian real estate litigation (AZB & Partners, updated 12 March 2026) notes that these state laws can impose special conditions and override contract terms. Where such an act applies, eviction usually needs one of the grounds the act recognises, and the notice should say which ground you rely on. Check whether your premises fall within your act's coverage before drafting.
Section 106 default (15 days / 6 months)
If there is no clause and no state law to the contrary, Section 106 of the Transfer of Property Act fills the gap. A lease for any purpose other than agriculture or manufacturing is treated as month-to-month and can be ended by 15 days' notice. A lease for agricultural or manufacturing purposes is treated as year-to-year and needs six months' notice.
Model Tenancy Act states
The Model Tenancy Act, 2021 was approved by the Union Cabinet on 2 June 2021 as a template for states and union territories to adopt. It is not automatically in force everywhere. According to the Chambers 2026 guide, Andhra Pradesh, Tamil Nadu, Uttar Pradesh, Assam and Karnataka had adopted key MTA principles as of early 2026, while most states had not. If your state has an MTA-based law, its notice rules and forum apply, and the tenancy itself should be in writing and reported to the Rent Authority. Our Model Tenancy Act 2021 explained guide covers the Act section by section.
| Situation | Governing rule | Notice period | Source |
|---|---|---|---|
| Premises covered by a state rent control act | That act's grounds and procedure | As the act provides; a ground is usually needed | State statute (Chambers 2026 on override) |
| State has adopted an MTA-based tenancy law | State tenancy law, Rent Authority forum | As the state law and agreement provide | State law; PRS summary of MTA |
| Written agreement with a notice clause, no state act | The contract | Period stated in the clause | TPA S.106(1) "contract to the contrary" |
| Residential or commercial monthly tenancy, no clause | TPA default | 15 days, counted from receipt | TPA S.106(1), S.106(2) |
| Agricultural or manufacturing lease, no clause | TPA default | 6 months, counted from receipt | TPA S.106(1), S.106(2) |
If the tenancy ends and you plan to re-let, or the tenant agrees to stay on fresh terms, the cleanest fix is a new written agreement with a clear notice clause. You can create your rent agreement online for free and set the notice period, lock-in and deposit terms in writing. For how notice periods typically work for both sides, see our rent agreement notice period guide.
Legal notice to tenant to vacate format (copyable template)
Copy the format below into a word processor, replace every bracketed field, and delete the ground paragraphs that do not apply. Keep it factual; a notice is not the place for accusations you cannot document.
NOTICE TO VACATE AND DELIVER POSSESSION
(under Section 106 of the Transfer of Property Act, 1882 [and/or the applicable state rent law: name of Act])Date: [DD/MM/YYYY]
Mode of service: [Registered post A.D. / Speed Post / hand delivery]From: [Landlord's full name], [son/daughter/wife of ...], residing at [address] ("the Landlord")
To: [Tenant's full name], residing at [address of the rented premises] ("the Tenant")
Subject: Termination of tenancy of [flat/house/shop no., building, street, city, PIN]
1. You are a tenant of the above premises under [a rent agreement dated ... / an oral monthly tenancy that began on ...] at a monthly rent of Rs [amount], payable on or before the [day] of each month.
2. [Insert the ground paragraph that applies, from the section below.]
3. I hereby terminate your tenancy with effect from the expiry of [the notice period stated in clause ... of the agreement / fifteen days / the period required by the applicable law] from the date you receive this notice, that is, on or before [termination date].
4. You are required to vacate the premises and hand over vacant and peaceful possession, together with all keys, to me on or before [termination date], and to pay all arrears of rent and charges up to the date of handing over, amounting to Rs [amount] as on the date of this notice.
5. The security deposit of Rs [amount] will be dealt with as provided in the rent agreement after a joint inspection and adjustment of lawful dues.
6. If you fail to comply, I shall be constrained to initiate appropriate legal proceedings for recovery of possession, arrears and compensation for use and occupation, at your risk as to costs.
[Signature]
[Landlord's name] / [Name of advocate or authorised representative, on behalf of the Landlord]
Office copy retained.
Each element maps to a requirement. Writing and signature satisfy Section 106(4). Counting from receipt reflects Section 106(2). The clause naming the basis of the tenancy and the rent shows which notice period you rely on. Section 106(3) offers some protection if you miscalculate: a notice is not invalid merely because the period it states falls short of the statutory period, provided any suit or proceeding is filed only after the statutory period has expired. That is a safety net, not a drafting method, so calculate the date properly.
Wording by ground
Under the Section 106 default, a landlord ending a monthly tenancy does not have to give a reason. Under a state rent act, or a state law based on the Model Tenancy Act, the ground matters, because eviction is usually allowed only on grounds the law lists. Paste the relevant paragraph into point 2 of the template.
Rent arrears
"You have failed to pay rent for the months of [months], amounting to Rs [amount], despite my reminders dated [dates]." Keep a ledger of rent received and unpaid, bank statements and copies of reminders. The PRS summary of the Model Tenancy Act lists rent unpaid for more than two months as a repossession ground, alongside refusal to pay the agreed rent.
Agreement expired / not renewing
"The rent agreement dated [date] expired on [date] and I do not intend to renew it." Attach or reference the agreement. If the tenant has continued to pay and you accepted rent after expiry, the tenancy may have continued month to month, so say clearly that you now terminate it.
Personal or family need
"I require the premises bona fide for my own occupation / for occupation by [family member], who [reason]." Bona fide personal requirement appears as a ground in many state rent acts, but the conditions differ from act to act, so read yours before relying on it. Keep evidence that the need is genuine.
Unauthorised subletting or misuse
"You have sublet / parted with possession of [part of] the premises to [name, if known] without my written consent" or "You are using the premises for [purpose], contrary to clause [ ] of the agreement, and have continued after my written notice dated [date]." Both appear among the MTA repossession grounds summarised by PRS.
Structural changes without consent
"You have carried out [describe work] without my written consent." Photographs with dates and any earlier written objection are the evidence that counts.
| Ground | What to state in the notice | Evidence to keep | Where it is a recognised ground |
|---|---|---|---|
| Rent arrears | Months unpaid, amount, dates of reminders | Rent ledger, bank statements, reminder copies | MTA-based laws (rent unpaid more than two months, or refusal to pay); most state rent acts |
| Expiry / non-renewal | Agreement date, expiry date, decision not to renew | Signed agreement, rent receipts after expiry | Contract and TPA S.106 default; state acts may still require a statutory ground |
| Personal or family need | Who needs it and why, in one or two lines | Proof of the need (job transfer, family circumstances) | Several state rent acts; conditions vary |
| Subletting / parting with possession | That it happened without written consent | Photos, names of occupants, society records | MTA-based laws; most state rent acts |
| Misuse after written notice | The misuse and the earlier notice date | Copy of the earlier notice, photographs | MTA-based laws |
| Structural changes without consent | The work done and absence of consent | Dated photographs, written objection | MTA-based laws |
Serving the notice: Section 106(4) modes and your proof file
Section 106(4) lists how a notice is to be served: sent by post to the party, or tendered or delivered personally to the party, or to a member of the party's family or a servant at the party's residence. If none of these is practicable, it may be affixed to a conspicuous part of the property. Whichever route you use, assemble a proof file on the day you send it.
| Method (S.106(4)) | Proof to keep | Notes |
|---|---|---|
| Registered post A.D. or Speed Post via India Post | Postal receipt, tracking printout, returned A.D. card, office copy | Address it to the rented premises and any other known address |
| Hand delivery to the tenant | Acknowledgement signed and dated on your office copy | Take an independent witness |
| Delivery to a family member or servant at the residence | Name of the person, date, time, witness signature | Note the relationship of the recipient |
| Affixing on the property (if other modes are not practicable) | Dated photographs, witness statement, note of why other modes failed | Use only after attempting the other modes |
| Email or WhatsApp | Screenshots with delivery ticks, email headers | Use as a supplement; S.106(4) does not list these modes |
If the tenant refuses a registered letter, keep the returned envelope unopened with the postal remark. Courts have often treated refusal as service, but whether it counts in your case is a question for your advocate.
What happens after the notice period ends
Tenant leaves: inspection and deposit
Do a joint inspection with the tenant, note meter readings, collect every key and record the handover in writing. Settle the deposit as the agreement provides. Under the Model Tenancy Act framework the deposit is capped at two months' rent for residential premises and six months' for non-residential, so in MTA-based states an excessive deposit is itself a problem. Our guide to security deposit rules explains deductions.
Tenant stays: which forum
A notice does not by itself remove anyone. If the tenant stays, recovery of possession happens through the forum your regime provides. Section 5 of the Specific Relief Act, 1963 says a person entitled to possession of immovable property may recover it in the manner provided by the Code of Civil Procedure, 1908, which is a civil suit in an ordinary case. In Maharashtra, the Chambers guide notes that the Presidency Small Causes Courts Act, 1882 gives eviction jurisdiction to the small causes courts and no other court may hear such cases. In MTA-based states, disputes go to a three-tier structure: Rent Authority, Rent Court and Rent Tribunal, with civil courts barred from matters under the Act.
Overstay compensation in MTA states
Under the Model Tenancy Act, a tenant who stays on after the tenancy expires or is terminated must pay twice the monthly rent for the first two months and four times the monthly rent after that, until they leave. Whether this applies to you depends on your state's own law. In other states, a landlord may claim compensation for use and occupation (often called mesne profits) in the eviction proceedings.
What a landlord must not do
Changing the locks, removing the tenant's belongings, cutting water or electricity, or using force to get the premises back is not lawful eviction. The Chambers guide notes that forceful eviction is not permissible and that criminal proceedings under the Bharatiya Nyaya Sanhita, 2023 are possible where a landlord's conduct threatens the tenant's life or property. Self-help can also be reversed: under Section 6 of the Specific Relief Act, a person dispossessed without consent and otherwise than in due course of law can sue to recover possession within six months. Under the MTA, the Rent Authority can order withheld essential services to be restored and award compensation. Each of these shortcuts ends up delaying the very outcome the landlord wanted.
Pre-send checklist
- Identify which layer governs: state rent act, MTA-based state law, agreement clause or the Section 106 default.
- Confirm the notice period and add delivery margin, because time runs from receipt.
- Name the ground if your law requires one, and keep the evidence for it.
- Check the names, premises address and agreement date against the agreement itself.
- Sign the notice yourself or have an authorised person sign it on your behalf.
- Serve it by a Section 106(4) mode and build the proof file the same day.
- Calendar the expiry date, and do not file proceedings before the statutory period has run.
- When you re-let, remember that registration under Section 17(1)(d) of the Registration Act, 1908 is compulsory for leases from year to year, for a term exceeding one year, or reserving a yearly rent. Draft the new agreement's term with this in mind.
- Have a local advocate read the final notice before it goes out.
Frequently asked questions
How many days notice must a landlord give a tenant in India?
It depends on which rule governs. A notice clause in the agreement usually applies; a state rent act or MTA-based state law can override it. If none applies, Section 106 of the Transfer of Property Act gives 15 days for a monthly tenancy and six months for an agricultural or manufacturing lease, counted from the date the tenant receives the notice.
Does a notice to vacate need stamp paper or notarisation?
Section 106(4) asks for a notice in writing, signed by or on behalf of the person giving it, and served in one of the listed ways. It does not mention stamp paper or notarisation. Check your state law and agreement for any extra requirement, and keep a signed office copy.
Can I send the notice by WhatsApp or email?
Section 106(4) lists post, personal delivery to the tenant or a family member or servant at the residence, and affixing on the property. Email and WhatsApp are not among them, so use them only as a supplement to registered post or hand delivery.
What if the tenant refuses to accept the notice?
Keep the returned envelope unopened with the postal remark, plus your tracking record and witness details. Courts have often treated refusal as service, but whether it holds in your case is a question to put to your advocate. Affixing on the property is the fallback when other modes are not practicable.
Do I need a lawyer to send a legal notice to a tenant?
Not by statute: the notice may be signed by the landlord or by someone on the landlord's behalf. Many landlords still use an advocate because the ground, the period and the forum differ by state, and errors cost time in court. This page is general information, not legal advice.
