Tenant Rights Without a Rent Agreement (India Guide)
Key takeaways
- An oral tenancy with possession is a valid lease if it is not for a term exceeding one year, year to year or at a yearly rent (TPA Section 107).
- Without a contract or local law to the contrary, a residential lease is month to month and ends on fifteen days' notice (TPA Section 106).
- A tenant in settled possession cannot be removed by force; eviction must go through law (Rame Gowda v. M. Varadappa Naidu).
- State rent laws, including those based on the Model Tenancy Act, 2021, can override the defaults; the MTA binds only where enacted.
- Proof is the weak point: switch to traceable rent payments, collect receipts and put the terms in writing.
Tenant rights without rent agreement still exist. Under the Transfer of Property Act, 1882, an oral tenancy with possession is a valid lease unless it is year to year, for over one year or at a yearly rent. It is month to month, ended by fifteen days' notice (Section 106) unless state law or contract differs. Forcible eviction is barred.
Below: where a tenant without a rent agreement stands, which law sets your notice period, how lawful eviction differs from illegal eviction, and how to build evidence before a dispute starts. It is general information, not legal advice; for a live dispute, speak to a lawyer in your state.
Short answer: you still have rights, but proof is your weak point
Plenty of lettings in India start on a handshake: a rent is named, a deposit paid, the keys handed over, and nothing is signed. That is not illegal, and it does not leave you unprotected. Three rules from central law do most of the work:
- The tenancy itself is valid. Section 107 of the Transfer of Property Act, 1882 lets a lease that is not from year to year, not for a term exceeding one year and not reserving a yearly rent be made by an oral agreement accompanied by delivery of possession. A verbal rent agreement in India plus the keys is therefore a lease.
- There is a default term and notice period. Section 106 says that, in the absence of a contract or local law or usage to the contrary, a lease for a purpose other than agriculture or manufacturing is deemed month to month and is terminable by either side on fifteen days' notice.
- Eviction must go through law. The Supreme Court of India has held that a person in settled possession cannot be dispossessed, even by the owner, except by recourse to law.
What you lack is a document proving the rent, the deposit, the start date and any promises made. Every protection above depends on first showing that you are a tenant, not a guest or a licensee. Is an oral tenancy legal in India?
What Section 107 allows
Yes. The Transfer of Property Act, 1882 sets out how leases of immovable property are made. Under Section 107, a lease from year to year, for any term exceeding one year, or reserving a yearly rent can be made only by a registered instrument. All other leases may be made either by a registered instrument or by an oral agreement accompanied by delivery of possession. A monthly oral tenancy, where you pay monthly rent and live in the flat, falls in the second group. An oral tenancy in India is legal so long as it stays inside those limits.
Where an unwritten lease stops working: terms over one year
Trouble starts when the oral deal includes a long promise, such as "you can stay three years at this rent". A lease for a term exceeding one year can be made only by a registered instrument, and a registered lease instrument must be executed by both lessor and lessee. Section 49 of the Registration Act, 1908 adds that a document required to be registered under Section 17 that is not registered does not affect the immovable property comprised in it and cannot be received as evidence of a transaction affecting that property, although the proviso allows it as evidence of a collateral transaction.
So an oral promise of a multi-year stay is not enforceable as a multi-year lease, and you are likely to be treated as a month-to-month tenant under the default notice rules below. If a long stay matters, put it in a written, stamped and registered lease.
Your default term and notice period without a rent agreement
The 15-day rule in Section 106
For a home, shop or office, Section 106 deems the lease to run month to month when nothing else governs it, and either the lessor or the lessee may end it by fifteen days' notice. Section 106(2) says the notice period runs from the date the notice is received. The same section treats leases for agricultural or manufacturing purposes as year to year, ended by six months' notice. This month to month tenancy in India is the starting point for most oral residential lets.
Notice works both ways. If you want to leave, give your landlord the same written notice and keep proof of receipt, such as a signed copy or a delivered message. Our rent agreement notice period guide covers notice under a written agreement.
When your state rent law overrides it
Section 106 applies only "in the absence of a contract or local law or usage to the contrary". A state rent control act, or a state law based on the Model Tenancy Act, 2021, can replace the default with its own notice periods, eviction grounds and forum. Notice periods and deposit rules therefore differ from state to state, and this guide does not list them. Before acting on the fifteen-day rule, check the rent law in force where the property is, or ask the local Rent Authority where one exists.
Use this order to see which rule governs you:
| Your situation | Rule to check first | What to check |
|---|---|---|
| State has enacted a law based on the Model Tenancy Act, 2021 | That state law, including its Rent Authority and Rent Court | Whether your tenancy is covered and how it must be recorded |
| Older state rent control act covers your area and premises | The rent control act's notice and eviction grounds | Coverage limits in the act (area, type of premises) |
| No state law applies to your premises | Transfer of Property Act, 1882: Section 106 default, Section 107 form | Whether any oral term changes the default |
Can a landlord evict you without a rent agreement?
No self-help eviction
Not by force. Changing the locks or throwing out your belongings is not a lawful way to end a tenancy. In Rame Gowda v. M. Varadappa Naidu, the Supreme Court of India held that a person in settled possession cannot be dispossessed even by the true owner except by recourse to law. That principle is why a tenant who has lived in a flat and paid rent for months cannot simply be locked out, and why eviction without a rent agreement still requires due process.
How a lawful eviction happens
This does not mean an oral tenant can never be evicted. A landlord who follows the law can end the tenancy. Under the Transfer of Property Act default, that means a valid notice; if you do not leave after it expires, the landlord's route is the competent court or forum, not force. In a state that has adopted the Model Tenancy Act, 2021, the forum is the Rent Court, and the model law's eviction grounds include refusal to pay rent, non-payment of rent for more than two months, and parting with possession without written consent. Under an older rent control act, the act's own grounds apply.
If someone tries to remove you by force, keep a record of what happened, preserve your evidence of tenancy, and seek legal help quickly.
Deposit, rent increases and repairs when nothing is written
Getting your security deposit back
A security deposit paid in cash with no receipt is the hardest money to recover. Your claim depends on proving you paid it: a bank or UPI transfer, a message from the landlord acknowledging it, or a witness. Where a state has enacted the Model Tenancy Act, 2021, the model law caps the security deposit at two months' rent for residential premises and six months' rent for non-residential premises. That cap is not law in states that have not adopted it.
Rent increase without an agreement
With no written escalation clause, any rent increase is something to negotiate, subject to your state's rent law where one applies. Because the default monthly tenancy can be ended on notice, a landlord who wants more rent can in practice give notice and offer a new rent. Ask for any agreed increase in writing so it becomes part of your evidence. For increases under a written agreement, see our guide to rent increase rules in India.
Repairs and landlord entry
Repairs, maintenance costs and landlord visits are easy to leave unspoken in an oral tenancy. Without a written clause, they turn on what you can prove was agreed and on state law. Record every request and reply by message, so that the pattern becomes evidence.
How to prove you are a tenant: evidence that works
Proof decides almost every dispute in an oral tenancy. Practical lists of useful evidence include bank or UPI transfer records, rent receipts, utility bills at the address, WhatsApp or email messages, witnesses, and move-in photos or videos. The table shows what each item proves and how to secure it today. The strength column is practical guidance, not a legal rule.
| Evidence | What it proves | How to get it now | Strength |
|---|---|---|---|
| Bank or UPI transfer history to the landlord | Regular rent amount, payee, dates | Download statements; add a note such as "rent for March" on future transfers | Strong |
| Signed rent receipt | Tenancy, rent amount, period paid | Ask for a receipt for every payment, especially cash | Strong |
| Deposit transfer or written acknowledgement | Amount of security deposit paid | Find the original transfer; ask the landlord to confirm by message | Strong |
| Utility bills at the address | Residence at the property over time | Keep electricity, gas or internet bills that show the address | Moderate |
| Police verification record | Landlord registered you as a tenant | Ask for a copy of the tenant verification submitted | Moderate |
| WhatsApp or email messages | Agreed terms, start date, repair requests | Export chats; summarise agreed terms and ask for a reply | Moderate |
| Move-in photos or videos | Start date and condition of the premises | Keep dated originals; take fresh photos now | Supporting |
| Witnesses | Payments made, terms agreed | Note names of people present at handover or payment | Supporting |
The most useful single step is turning cash rent into a traceable bank or UPI payment, ideally with a short remark each month. A rent receipt for every payment closes the remaining gaps.
With vs without a rent agreement: side by side
The table sets out how the main points change once terms are written down. Where a state has adopted the Model Tenancy Act, 2021, letting is to be done only by written agreement, and the agreement is to be informed to the Rent Authority within two months.
| Issue | With written agreement | Without (oral tenancy) | Legal basis |
|---|---|---|---|
| Validity | Valid; registration needed if the lease is year to year, for a term exceeding one year, or reserves a yearly rent | Valid only for leases that do not need a registered instrument | TPA Section 107 |
| Term | As written | Deemed month to month for residential and commercial use | TPA Section 106 |
| Notice to end | As written, subject to state law | Fifteen days unless contract, local law or usage says otherwise | TPA Section 106 |
| Deposit | Amount and refund terms on paper | Depends on proving payment | Evidence; MTA cap where enacted |
| Rent increase | Escalation clause, if any | Only by agreement or after notice | Contract; state law |
| Eviction route | Notice, then court or Rent Court | Same: no forcible dispossession | Rame Gowda principle; state law |
| Long stay promised | Enforceable if registered | Not enforceable as a multi-year lease | TPA Section 107; Registration Act Section 49 |
| Proof | The agreement itself | Receipts, transfers, bills, messages | Evidence |
The Model Tenancy Act, 2021, a model law from the Ministry of Housing and Urban Affairs, was approved by the Union Cabinet on 2 June 2021 for adoption by states and union territories. It is a model law: it binds only where a state enacts it, and earlier model acts were not adopted by most states. The PRS Legislative Research summary of the Model Tenancy Act, 2021 sets out its Rent Authority, Rent Court and Rent Tribunal structure.
Putting it in writing now: a 4-step plan
Converting an oral tenancy into a written one protects both sides, and it is simplest while relations are still friendly.
- Gather your evidence. Collect transfer records, receipts and messages so both sides agree on the start date, rent and deposit already paid.
- Agree the terms. Settle rent, deposit, notice period, maintenance, repairs and the term. Keep the term under one year, for example 11 months, unless you are ready to register a lease.
- Draft the document. Use the free generator to prepare the agreement. It supports India, the US, the UK, Canada and Australia, fixed-term or month-to-month tenancies, and covers parties, premises, rent, deposit, late fee, utilities, notice and governing law. All data stays in your browser and nothing is uploaded. Our guide on how to make a rent agreement walks through each field.
- Stamp and sign. Execute the agreement on the stamp paper or e-stamp required in your state; Delhi's revenue department, for example, states that stamp duty on a lease or rent deed is payable by the lessee. If no agent is involved, see our guide to a rent agreement without a broker.
The site gives no legal advice and does not provide notary or registration services; it only helps you produce the document. Turn your current arrangement into a written 11-month agreement with the free generator today, and keep the evidence you gathered in step one.
Frequently asked questions
Is a verbal rent agreement legally valid in India?
Yes, for a tenancy that does not need registration. Under Section 107 of the Transfer of Property Act, 1882, a lease that is not from year to year, not for a term exceeding one year and not reserving a yearly rent can be made by an oral agreement accompanied by delivery of possession. A promise of a stay longer than one year needs a registered instrument.
Can my landlord evict me without a written agreement?
Yes, but only lawfully. The landlord can end the tenancy by valid notice and, if you do not leave, must go through the competent court or forum. The Supreme Court of India held in Rame Gowda v. M. Varadappa Naidu that a person in settled possession cannot be dispossessed except by recourse to law, so changing the locks or removing your belongings is not a lawful route.
What notice period applies if there is no rent agreement?
Under Section 106 of the Transfer of Property Act, 1882, a non-agricultural, non-manufacturing lease is deemed month to month and is terminable by either side on fifteen days' notice, counted from receipt. This applies only in the absence of a contract or local law or usage to the contrary, so check your state's rent law first.
How can I prove I am a tenant without an agreement?
Use bank or UPI transfer records, rent receipts, utility bills at the address, WhatsApp or email messages, any police verification record, move-in photos and witnesses. Traceable monthly payments and signed receipts are the strongest evidence.
Can I get my security deposit back without an agreement?
You can claim it, but you must prove you paid it, for example through a bank or UPI transfer or a written acknowledgement from the landlord. Where a state has adopted the Model Tenancy Act, 2021, the residential deposit is capped at two months' rent; elsewhere, your state's law applies.
Does the Model Tenancy Act 2021 apply in my state?
Only if your state or union territory has enacted a law based on it. It is a model law approved by the Union Cabinet on 2 June 2021 for adoption by states and union territories, and it is not binding nationwide. Check your state's current rent law.
