How to Cancel a Registered Rent Agreement in India (2026)

Key takeaways

Wondering how to cancel a registered rent agreement? The short answer: a registered rent agreement cannot be cancelled by one party on its own. The tenancy ends by expiry or by notice under the agreement; the registered record is then closed by a mutual cancellation or surrender deed signed by landlord and tenant, witnessed, and in most states presented to the same Sub-Registrar office that registered the original. Settle the deposit and hand over possession in writing on the same day.

This guide is for anyone who registered a lease of twelve months or longer, or a Maharashtra leave and licence agreement, and now wants out early or wants the record closed cleanly at expiry. It covers the law that makes the exit mutual, the step-by-step process, the documents, the state variations and the loose ends (deposit, police intimation, society NOC). If you are still deciding whether to register at all, start with our guide to the registered rent agreement process and come back here when the tenancy is ending. As of October 2026 the position below is general; confirm state practice with your Sub-Registrar or an advocate, because this is not legal advice.

Ending the tenancy versus cancelling the registered deed

Two different things get called "cancellation". The first is ending the tenancy, which is governed by the agreement and the Transfer of Property Act, 1882. The second is closing the registered record of that agreement at the Sub-Registrar, which is governed by the Registration Act, 1908. Most disputes start because one side thinks a notice letter does both jobs.

How a lease ends under Section 111 of the Transfer of Property Act

Section 111 TPA lists the ways a lease determines. The ones that matter for a rent agreement are: efflux of time, when the term runs out (clause a); express surrender, when the tenant gives up the interest by mutual agreement with the landlord (clause e); implied surrender (clause f); forfeiture, where the tenant breaks a condition and the landlord gives written notice of intention to end the lease (clause g); and expiry of a notice to quit (clause h). Section 106 TPA supplies the default notice period where the agreement is silent, though a written agreement's own notice clause normally governs. For the mechanics of serving notice, our rent agreement notice period guide covers the ordinary exit.

Why the exit instrument is itself registrable

Section 17 of the Registration Act, 1908 is the starting point. Section 17(1)(d) makes leases "from year to year, or for any term exceeding one year, or reserving a yearly rent" compulsorily registrable. Section 17(1)(b) goes further: any instrument that creates, declares, assigns, limits or extinguishes a right, title or interest worth one hundred rupees or more in immovable property must be registered. A surrender deed or cancellation deed extinguishes the tenant's leasehold interest, which is why the common advice (and the practice of most Sub-Registrar offices) is to register the exit deed where the original was registered. Section 49 adds the penalty for skipping it: an unregistered document that required registration does not affect the property and is not received as evidence of the transaction, with limited exceptions. State practice on whether a short exit deed is insisted upon varies, so confirm with the state IGR or the Sub-Registrar before you draft.

How to cancel registered rent agreement records, step by step

1. Read the notice, lock-in and early-exit clauses

Start with the agreement itself. Find the notice period, the lock-in period if any, what happens to the deposit on early exit, and any clause on mutual termination. A lock-in clause may make early exit expensive rather than impossible; the way out is still a mutual deed, with the compensation written into it.

2. Serve written notice

Send the notice by registered post with acknowledgement and by email to the address in the agreement, stating the exit date. Keep the postal receipt. If the agreement is silent, Section 106 TPA supplies the default period. The notice ends the tenancy; it does not close the registered record, which is why steps 4 and 5 follow.

3. Settle dues and inspect jointly

Clear rent, electricity, water, gas, society or maintenance charges up to the exit date, and do a joint inspection of the premises against the inventory or move-in photographs. Agree the deductions, if any, from the security deposit in writing. The NoBroker forum's widely read answer on cancelling rental agreements (September 2026) puts these steps in the same order: notice, settle dues, joint inspection, deed, deposit.

4. Draft the mutual cancellation or surrender deed

The deed should contain: the names, addresses and ID details of both parties; the registration details of the original agreement (document number, book, date and Sub-Registrar office); the premises description; a recital that the parties have mutually agreed to surrender the tenancy with effect from a stated date; a statement that possession has been or will be handed over on that date; the deposit settlement (amount refunded, deductions, or that nothing is due); a mutual release of further claims; and signature blocks for both parties and two witnesses. Call it a surrender deed when the tenant gives up the lease to the landlord, or a cancellation deed when both parties agree to treat the agreement as ended; for a rent agreement the content is the same and the Sub-Registrar looks at the substance.

5. Sign with two witnesses and register where the original was registered

Both parties sign, two witnesses attest, and the deed is presented at the Sub-Registrar office with jurisdiction over the property, normally the office that registered the original. Both parties (or their holders of registered power of attorney) must appear for photographs, thumb impressions and identity checks. Stamp duty on the exit deed is nominal and state-specific; check the state stamp schedule or the SHCIL e-stamp portal for the current amount, as this guide quotes no figure. In Maharashtra, leave and licence agreements are registered online and the cancellation can also run through the e-registration route; other states combine an e-stamp with a physical Sub-Registrar visit.

6. Deposit refund, handover letter, keys and copies

Refund the deposit by bank transfer against a signed receipt, exchange a possession handover letter dated the exit day, hand over keys and access cards, and give each party a copy of the registered deed with the registration receipt. Our guide to security deposit rules in India covers what a landlord may lawfully deduct.

Can a landlord or tenant cancel it alone? What the Supreme Court says

No. The Supreme Court has held, as a general principle applied by High Courts to lease deeds, that a registered deed cannot be cancelled by one side. In ITC Limited v. State of Uttar Pradesh (2011), a case about a lease granted by a statutory body, the court held that a unilateral cancellation by the lessor neither terminates the lease nor has any legal effect unless a statute reserves that power. In Satya Pal Anand v. State of Madhya Pradesh (2016), concerning a registered deed extinguishing rights in property, the court said that a cancellation deed cannot be executed or registered by one party alone, and that the Sub-Registrar's role is administrative, not adjudicatory. Thota Ganga Laxmi v. Government of Andhra Pradesh (2010), a sale deed case, sent the aggrieved party to the civil court rather than to the registry. A Casemine legal column on cancellation of registered lease deeds, and Madras and Andhra Pradesh High Court decisions applying Satya Pal Anand to cancellation deeds, treat these as one principle: a registered record is closed by both parties or by a court, not by one party's deed. None of the three Supreme Court cases was itself about a residential rent agreement, so cite them for the principle, not the facts.

What the Sub-Registrar will and will not do

A Sub-Registrar presented with a cancellation deed signed by only the landlord or only the tenant should decline to register it, and even if it slips through it does not undo the lease. A tenant who receives a "cancellation" from the landlord alone still holds the tenancy until it ends under Section 111 TPA or a court says otherwise.

Remedies when the other side refuses

Send a legal notice through an advocate setting out the breach or the exit date and calling for a mutual deed. In Tamil Nadu and in states that adopted the Model Tenancy Act, 2021 framework, tenancy disputes go to the Rent Authority and Rent Court set up under the state Act; our Model Tenancy Act 2021 explainer lists what that framework changes. Elsewhere, a civil suit is the route, and Section 31 of the Specific Relief Act, 1963 lets a party ask the court to adjudge an instrument void or voidable and order its cancellation.

State variations

Maharashtra leave and licence

In Maharashtra, leave and licence agreements are registered regardless of term under the Maharashtra Rent Control Act, and the registration runs online through the state's e-registration system. A cancellation of a registered leave and licence agreement follows the same online route in practice; confirm the current process with the Maharashtra IGR or an authorised service provider, and keep the registration receipt of the original agreement handy because the system needs its document number.

Tamil Nadu and other state tenancy Acts

Tamil Nadu requires tenancy agreements to be registered with the Rent Authority under its 2017 Act, separately from the Sub-Registrar, and disputes go to the Rent Court; closing a tenancy there means informing the Rent Authority as well as executing the exit deed. Where a state has adopted the Model Tenancy Act framework, the Rent Authority is likewise the first forum. Check your state's tenancy portal before assuming the Sub-Registrar step is the only one.

Other states

Most other states follow the plain Registration Act route: e-stamp from SHCIL or the state stamp vendor, a physical appointment at the Sub-Registrar office, both parties present with witnesses. Our comparison of notarized versus registered rent agreements explains why a notarised eleven-month agreement needs no Sub-Registrar step at exit, only a written termination and deposit settlement.

Closing the loop: deposit, police intimation and paperwork

Three loose ends get forgotten. First, the security deposit: refund it by bank transfer, record the deductions, and sign a receipt; a deposit returned in cash without a receipt is the most common post-exit dispute. Second, police verification: some police portals and station registers accept an intimation that the tenant has vacated, which protects the landlord if the address is later misused; it is not mandatory everywhere, so check the local practice. Third, paperwork that depends on the agreement: a tenant who claimed HRA should keep the rent receipts and the exit deed for the tax file, and a landlord who issued GST invoices on a commercial tenancy should close the billing from the exit date. If you are moving to new premises, the free generator on this site drafts the next agreement in minutes. It does not produce cancellation deeds; have an advocate or the Sub-Registrar's document writer prepare that for your state.

Frequently asked questions

Can a registered rent agreement be cancelled before expiry?

Yes, if both parties agree. The tenancy ends on the agreed date by express surrender under Section 111(e) of the Transfer of Property Act, and the registered record is closed by a mutual cancellation or surrender deed signed by landlord, tenant and two witnesses, registered in most states. A lock-in clause may add a cost to early exit but does not change the mechanism.

Is a cancellation deed required to be registered?

Where the original agreement was registered, the usual practice is to register the cancellation or surrender deed at the same Sub-Registrar office, because Section 17(1)(b) of the Registration Act covers instruments that extinguish an interest in immovable property and Section 49 limits the evidentiary value of unregistered ones. State practice varies, so confirm with the state IGR or Sub-Registrar.

Can a landlord cancel a registered rent agreement unilaterally?

No. The Supreme Court principle from ITC Ltd v. State of UP and Satya Pal Anand v. State of MP, applied by High Courts to lease deeds, is that a registered deed cannot be cancelled by one party's deed; a unilateral cancellation has no legal effect and the Sub-Registrar should not register it. The landlord must end the tenancy by notice or forfeiture under the agreement, or go to the Rent Authority or civil court.

What is the difference between a surrender deed and a cancellation deed?

A surrender deed records the tenant giving up the leasehold interest to the landlord; a cancellation deed records both parties agreeing to treat the agreement as ended. For a rent agreement the contents are the same: parties, original registration details, effective date, possession handover, deposit settlement, mutual release, witnesses. Use the name your state's Sub-Registrar office expects.

What happens to the security deposit on cancellation?

It is settled on the exit date: agreed deductions for unpaid dues or damage are listed, the balance is refunded by bank transfer against a signed receipt, and the settlement is recorded in the exit deed or an annexed statement. Returning cash without a receipt is the most common cause of later disputes.
