Rent Agreement on Rs 100 Stamp Paper: Is It Valid?

RA By Rent Agreement Generator Editorial· Updated 2026-10-07·8 min read

Key takeaways

A rent agreement on 100 rs stamp paper is properly stamped only if your state's duty on it is Rs 100 or less. Karnataka, Maharashtra and Telangana charge a percentage of rent (two also count the deposit), so Rs 100 covers only very small agreements. Under-stamped agreements can be impounded and used only after paying the deficit plus a penalty.

This page answers one question: is the Rs 100 sheet enough for your agreement, and what do you do if it is not? It uses the official state schedules, works out the rent level at which Rs 100 runs out, and explains the repair routes under the Indian Stamp Act, 1899. It is general information, not legal advice; for a disputed or high-value tenancy, ask a lawyer or the Sub-Registrar's office.

Is a rent agreement on 100 rs stamp paper valid? The short answer

Two different questions hide inside "valid". The first is whether the paper you signed on is a legitimate instrument: a genuine Rs 100 non-judicial stamp paper or e-stamp certificate is. The second, and the one that matters, is whether the agreement is duly stamped, meaning the stamp duty paid equals the duty your state charges on that particular agreement. Stamp duty is not a fee for the paper; it is a tax on the document, worked out from the rent, the term and, in some states, the deposit.

The Indian Stamp Act, 1899 sets the timing in section 17: a dutiable instrument executed in India must carry its stamp no later than the moment it is signed. Section 35 sets the consequence. A document carrying less duty than the law requires cannot be used as evidence, acted on, put on the register or authenticated. It can be brought back into use only by paying what is missing together with a penalty. So an under-stamped agreement is not simply thrown out; it becomes a document you cannot rely on until you pay.

Why does Rs 100 feel standard? Because it is repeated everywhere. Outlook Money (7 August 2025) describes 11-month agreements as typically signed on Rs 100 stamp paper, with duty "often just Rs 100", and a widely shown search summary calls Rs 100 the most commonly used value across India. Custom is not the law, though. In states that charge a percentage, the right value depends on your numbers.

When Rs 100 is enough: break-even rent by state

The table turns each state's official rule into the one number you need: the base (rent, plus deposit where the rule includes it) above which Rs 100 no longer covers the duty. The formulas themselves, with a fuller worked example, are on our guide to rent agreement stamp paper and registration costs.

StateRule (official source)What goes into the baseRs 100 covers the duty only if the base is at most
KarnatakaKarnataka Stamp Act, 1957, Schedule Article 30(1)(i): residential lease up to one year, fifty paise per Rs 100 or part, maximum Rs 500Average annual rent plus premium, fine and money advanced; the Explanation counts the security depositRs 20,000
MaharashtraMaharashtra Stamp Act, Article 36A(a): leave and licence agreement up to 60 months, 0.25 per centTotal licence fee or rent, plus any non-refundable deposit, plus interest at 10% a year on the refundable depositRs 40,000
TelanganaReady reckoner of the Telangana Registration and Stamps Department (G.O.Ms.No.58/59 dated 20.07.2021): 0.40 per cent on leases under one yearTotal rent for the termRs 25,000
DelhiDelhi Revenue Department: duty collected by e-stamp only (circular of 02-07-2015); the lessee paysLease rate not verified from the official scheduleNot calculated; confirm the duty for your article before buying the e-stamp

Break-even figures are our arithmetic from the stated rates (Rs 100 divided by the percentage). Translated into monthly rent for an 11-month agreement with no deposit in the base, Rs 100 is enough only up to roughly Rs 2,270 a month in Telangana and about Rs 3,600 a month in Maharashtra. In Karnataka the base is annual rent plus the deposit, so almost any real tenancy passes Rs 20,000 and the duty climbs towards the Rs 500 cap. For most city rents in these three states, Rs 100 is short.

Three worked examples

Each example is an 11-month rent agreement with ordinary city figures. Amounts are approximate where the official calculator applies its own rounding.

ExampleRent x monthsDepositDuty dueShort of Rs 100 by
Karnataka, residential, 11 monthsRs 10,000 x 11Rs 50,000 (counted in the base)0.5% of a base of at least Rs 1,60,000 is Rs 800 or more, so the Rs 500 cap appliesRs 400
Maharashtra, leave and licence, 11 monthsRs 15,000 x 11 = Rs 1,65,000Rs 50,000 refundable; 10% a year for 11 months adds about Rs 4,5830.25% of about Rs 1,69,583 = about Rs 424about Rs 324
Telangana, lease below one yearRs 12,000 x 11 = Rs 1,32,000Not in the base as stated0.40% of Rs 1,32,000 = Rs 528Rs 428

The Karnataka figure holds whether the average annual rent is taken as Rs 1,10,000 or Rs 1,20,000: either way the base is far above the Rs 1,00,000 at which the cap starts to bite. For Maharashtra, the Inspector General of Registration (IGR) Maharashtra runs the Leave and License 2.0 calculator, where you enter the term, rent, deposits and whether the property is urban or rural, and it returns the stamp duty, the registration fee and document handling charges. Use it for the exact rupee figure rather than our approximation.

What happens if your agreement is under-stamped

Impounding

Under section 33 of the Indian Stamp Act, 1899, anyone authorised by law to receive evidence, and anyone in charge of a public office other than a police officer, must impound a dutiable document produced before them if it does not appear to be duly stamped. They examine it against the duty that applied on the date it was executed. For a tenancy, that usually means a court hearing a rent or deposit dispute, or a public office such as a registration counter.

Deficit plus penalty

The proviso to section 35 lets the document in on payment of the missing duty plus a penalty. In the central Act's wording, that penalty is five rupees or, if larger, ten times the missing amount. Take the Telangana example above under that wording: duty Rs 528, paid Rs 100, deficit Rs 428. Ten times Rs 428 is Rs 4,280, so the total to make the agreement usable is Rs 428 + Rs 4,280 = Rs 4,708. With the Rs 100 already spent, that is about nine times the Rs 528 that correct stamping would have cost. Telangana applies the central Act as amended for the state, so the actual penalty may differ.

Karnataka and Maharashtra have their own Stamp Acts with their own penalty provisions, so do not apply the central figure there; ask the Collector of Stamps or the Sub-Registrar what applies in your district.

Already signed on Rs 100? How to fix it

If the tenancy is running smoothly, nothing forces the issue today. The cost shows up later, when one side needs to rely on the document. Fixing it early is cheaper:

  1. Work out the duty you should have paid. Use the rule in the table above or the state calculator. If the figure is unclear, section 31 of the Indian Stamp Act, 1899 lets anyone bring an instrument, signed or not, to the Collector for adjudication of the proper stamp; the Collector then determines the duty chargeable, for a small fee set by the applicable law.
  2. In Karnataka, check the two-month route. The state's Inspector General of Registration explains that a document can be written on plain paper, with the duty paid within two months of signing by DD, pay order or challan, after which the District or Sub Registrar certifies it. Ask the Sub-Registrar whether your agreement can be regularised this way if you are still inside two months.
  3. Consider re-executing. If both parties agree, signing a fresh agreement on an e-stamp certificate for the correct amount, dated before or at signing, removes the doubt from that date onward.
  4. Verify the new certificate. Stock Holding Corporation of India (SHCIL) says e-stamping is a secured electronic way to pay non-judicial stamp duty and had been rolled out in 26 States and UTs by 20 March 2025. Each certificate has a unique ID you can check online. Our e-stamp paper guide explains how to buy and check one.

Stamp paper is not registration

Paying the right stamp duty does not register an agreement. Registration is a separate step under the Registration Act, 1908, done before the Sub-Registrar with its own fee, and whether you need it depends on your state and term. In Maharashtra the IGR's Leave and License 2.0 portal calculates the registration fee alongside the duty. Delhi's Revenue Department FAQ states that leases of immovable property of value Rs 100 or more are compulsorily registrable. A Rs 100 sheet therefore tells you nothing about registration either way. For how the stamp sheet and continuation pages are laid out, see our rent agreement format on stamp paper.

Checklist before you buy stamp paper

You can draft the agreement free with the site's in-browser rent agreement generator (nothing you type is uploaded), then buy an e-stamp for the duty your state's schedule actually requires. The full text of sections 17, 31, 33 and 35 is in the Indian Stamp Act, 1899 published by the Puducherry Revenue Department.

Frequently asked questions

Is a rent agreement on Rs 100 stamp paper legally valid?

The paper is genuine, but the agreement is duly stamped only if Rs 100 equals or exceeds the duty your state charges on it. If duty is short, section 35 of the Indian Stamp Act, 1899 bars using it in evidence until the deficit and a penalty are paid.

Can I use Rs 100 stamp paper for an 11-month rent agreement in Bangalore?

Usually not. Karnataka charges fifty paise per Rs 100 of average annual rent plus money advanced, including the deposit, capped at Rs 500 for residential leases up to one year. Rs 100 covers it only if that base is Rs 20,000 or less.

What is the penalty for an under-stamped rent agreement?

Under the central Act's wording, the deficit plus a penalty of Rs 5 or ten times the deficit, whichever is higher. A Rs 428 shortfall would cost Rs 4,708 in total. Karnataka and Maharashtra have their own Stamp Acts, so check locally.

Can I add more stamp duty after signing?

Not by simply buying another sheet later, because section 17 requires stamping before or at signing. Options include adjudication by the Collector under section 31, paying the deficit and penalty, Karnataka's two-month route for plain-paper documents, or re-executing on a correct e-stamp.

Does stamp paper make a rent agreement registered?

No. Stamping pays the tax; registration under the Registration Act, 1908 is a separate step at the Sub-Registrar. Maharashtra's IGR Leave and License 2.0 portal shows the registration fee alongside the duty.
